A woman sued wine and spirit maker Bacardi Monday claiming she was seriously burned by flaming rum during a night out with a friend, who has also sued the company.

Agata Macierzynska is a friend of Danielle Alleyne, who had previously sued the company over an August 2002 incident at a Miami night club. Alleyne, of Miami, sued the company last week. Both women say they suffered serious burns after being hit by the flaming rum and claim one of Bacardi's products is defective and dangerous, the lawsuits said. They were filed in Miami-Dade County Circuit Court. The company said its product is clearly labeled with warnings against setting fire to it.

A bartender, who was not identified in either lawsuit, was pouring shots of Bacardi 151 when a customer lit a menu on fire and placed it in the stream of alcohol. The bottle that was being used to pour the shots turned into a flame thrower and sent flaming rum all over Macierzynska, the lawsuit said.

Macierzynska suffered second and third degree burns on her face, neck, arms, underarms, ears, back and hands and is permanently disabled and disfigured, the lawsuit said. Alleyne suffered similar burns, her lawsuit said. "Bacardi 151 carries a very clear label that warns against any flaming of the product," Bacardi USA, Inc. said in a statement. The Miami-based company said it had not been served with the lawsuit and could not comment on it.

--And why do people hate lawyers? Cases like these. Hmmm...alcohol + fire = ??? The woman should be sued for being a dumbass.

Is MySpace losing its cool? Margaret Marks, 17, thinks so. The Birmingham, Ala., high school senior was an avid user of the No. 1 social networking website for two years.

"But I never use it anymore, because most people my age now use Facebook," she says. "I can talk to people I haven't spoken to in years, and you can join college networks and meet people. MySpace is good for looking at bands and music, but for your own website, Facebook is much better."

As the social networking phenomenon continues to grow, competitors are snapping at MySpace's heels — er, portal. Facebook, Xanga, Wayn, vMix and others are salivating over MySpace's 95 million users and recent crowning by tracking service Hitwise as the Internet's most visited domain, surpassing longtime champ Yahoo Mail.

By some accounts, there are more than 200 sites, many aimed at niches. Facebook focuses on high school and college students, while vMix chases the camera-phone crowd with tools for elaborate video and slide shows. "The 12-34 demo wants to create and control their (media) experiences," says vMix's Terry Ash. "They want to flirt, they want attention, and they want to be noticed." Like MySpace, these sites let people join for free and create their own Web pages, complete with profiles, photos, blogs and messaging capabilities. They also let you add friends to your site.

Social networking sites have not been without their problems, from sexual predators to reports that cyber criminals may be targeting MySpace users. To deter predators, the House late Monday overwhelmingly passed a bill that would keep libraries and schools from allowing children to access social networking sites, as well as chat rooms. It now goes to the Senate.

Social networking sites remain immensely appealing to the young — and increasingly so to advertisers. This year, marketers will spend about $280 million to advertise on MySpace and its competitors, according to eMarketer's latest forecasts. By 2010, that figure could grow to $1.8 billion.

Toppling MySpace could be an uphill battle. According to Hitwise, in the week ending July 22, MySpace captured more than 81% of visits to online social networking sites, or about 52 million unique visitors, while Facebook was a distant No. 2 with 7.7%. Bridget Savant, 19, a college student in San Diego, says she briefly switched to Facebook but is back with MySpace. She says it's great for checking out potential dates. "It's like full access to someone's room and cellphone."

Elizabeth Hurley says she plans to marry her boyfriend, Indian businessman Arun Nayer, very soon.

"I can't tell you the exact date, but it is very close," the 41-year-old actress-model is quoted as saying in the Italian edition of Vanity Fair magazine. The couple have been dating since 2003.

Hurley, who has a 4-year-old son, Damian, with film producer Steve Bing, added: "We are also thinking of having a child."

Paris Hilton is back together with her ex-boyfriend, Greek shipping heir Stavros Niarchos – at least for now.

"We're together now here. We love each other," Hilton, who, like Niarchos, is in Saint-Tropez, said on Monday at Diddy's Unforgettable 50 party aboard a rented yacht.

While talking to People, Hilton paused for a moment to call Niarchos on her PDA. "Stav, where are you, baby?" she said. "Come on over. I love you." Seconded Hilton's friend, Carolina D'Amore, "They love each other very much."

Rumors of a possible split between Blink 182 drummer Travis Barker and his wife, Shanna, are heating up.

The other night, the two showed up and partied separately at Hollywood hot spot Privilege. The rocker gladly signed autographs for fans, but when Shanna saw him taking a picture with an attractive female, sources say she stormed over, threw her drink on the young woman and her glass at her husband. Barker's rep, Dvora Vener, said, "No comment."

Mel Gibson has sought treatment for alcoholism, his rep, Alan Nierob, said.

"He definitely entered a program," said Nierob, who wouldn't identify or describe the program or say how long Gibson planned to be there. Gibson was arrested on suspicion of driving under the influence in Malibu early Friday morning.

Although Fantasia: Life is Not a Fairy Tale – the TV movie about third-season American Idol winner Fantasia Barrino's difficult past – is not due to air on Lifetime until Aug. 19, producers of the FOX talent show reportedly are already crying foul over their depiction in the biopic.

"Certainly, under no circumstances was she ever approached to be talked out of taking part in (the show)," Idol executive producer Ken Warwick tells the New York Post, in response to the tele-movie's claim that Barrino was urged to withdraw from the competition because – as an unwed mother and high-school drop-out – she was not a suitable role model.

"We knew she had a baby right from Day One, and she was always strongly tipped to win the competition because she was so good," insists Warwick, adding, "I can absolutely refute that nothing was done, or even remotely suggested to her that she shouldn't take part in the competition. It's a complete fabrication."

According to the Post, the movie opens with the then-19-year-old Barrino's coming off the Idol stage and being asked to speak with producers, who confront her with Internet postings about her suitability to compete. "It's absolutely and totally untrue," Warwick responds. "I'm the executive producer, Nigel (Lythgoe) is the other executive producer and nobody – to my knowledge – would have said anything like that to her."

There has been no comment from Barrino on Warwick's claims.

Earlier this month, the singer told the Television Critics Association at its summer meeting that the movie – in which she plays herself – was a difficult experience for her because, among other reasons, she had to relive the rape the resulted in her having a child. Still, she said, she believes her story can inspire others. "At the end, I began to cry and I said, 'I went through all those things, but I know why I share my life.' I'm thankful that I was able to do it," she said.

Brad Pitt has told his grandmother that he will not marry Angelina Jolie. The actor telephoned his 83-year-old gran, Betty Russell, and told her he will not wed his new love as he is still not over his divorce from Jennifer Aniston.

Betty told Britain's Star magazine: "Brad promised his wife on their wedding day they'd be together, and they didn't make it. He is a sensitive soul who just wants to make sure he can keep his promise this time around."

Betty has also revealed how happy Brad is being a dad. The 'Troy' star celebrated the arrival of his first biological child, Shiloh Nouvel, in May, and has become a legal guardian to Angelina's two adopted children, Maddox and Zahara. Betty said: "Brad has always wanted to have children and he is playing the father role very well. Yes, the family loved Jennifer. But he has got Angelina now and seems very happy."

MTV announced its nominees for the 2006 MTV Video Music Awards on Monday, with Shakira and the Red Hot Chili Peppers leading the list with seven nominations each.

Both will compete for video of the year – the Peppers' "Dani California" and Shakira's "Hips Don't Lie" will go up against Christina Aguilera's "Ain't No Other Man," Madonna's "Hung Up" and Panic! At The Disco's "I Write Sins Not Tragedies."

Shakira and Aguilera are also in the running for best female video, along with Kelly Clarkson ("Because of You"), Nelly Furtado ("Promiscuous") and Madonna – whose "Hung Up" is also in the running for best dance video, best pop video and best choreography.

In third place with four nominations, Aguilera earned nods for best pop video and best choreography in addition to video of the year and best female video.

Nick Lachey's "What's Left of Me" is up for best male video against James Blunt's "You're Beautiful," Kanye West's "Gold Digger," T.I.'s "What You Know" and Busta Rhymes's "Touch It Remix."

Best group video contenders are the Chili Peppers, Panic! At the Disco, the All-American Rejects ("Move Along"), Fall Out Boy ("Dance, Dance") and Gnarls Barkley ("Crazy").

Scheduled to air live at 8 p.m. ET on Aug. 31, the 2006 MTV VMAs will take place at New York City's Radio City Music Hall and include performances by Beyonce, Justin Timberlake, Panic! At The Disco, the Killers and rappers T.I. and Ludacris.

The Raconteurs, fronted by the White Stripes' Jack White, will provide the show's "soundtrack," according to MTV.

For the first time, viewers may vote for their favorite videos in each category through Aug. 20 by visiting MTV's Web site. Voting for the viewer's choice award is open from Aug. 7-31.

Guns n' Roses frontman Axl Rose was taken ill on Sunday night, during the final UK date of the band's current tour.

The singer left the Wembley Arena stage and was replaced by Skid Row singer Sebastian Bach for the songs 'Night Train' and 'Paradise City'.

A UK representative for Guns N' Roses could not confirm the specific details behind Rose's illness.

Boy George will perform his court-ordered community service by picking up trash on city streets in the August heat, a sanitation spokesman said.
The one-time Culture Club singer will be issued a shovel, broom, plastic bags and gloves when he reports for five days of work on Aug. 14, department spokesman Vito Turso said.

"This is the epitome of community service," Turso told the Daily News for Monday editions. "It's not like he's going to be working in an air-conditioned office."

Born George O'Dowd, the singer has struggled with drug problems for years. He was ordered to do community service after pleading guilty in March to false reporting of an incident. He called police with a bogus report of a burglary at his lower Manhattan apartment in October, and the responding officers found cocaine inside. Turso's statement was the first indication of what sort of work the singer would be given. He could be assigned to pick up streets in Chinatown, Little Italy, Nolita or parts of the Lower East Side.
